Allstate - Car Value Dispute
I was in a car accident about a week ago. Allstate (the other drivers insurance company) accepted full liability for the accident, so I am filing my claim through them.
Long story short I have a 2007 Lexus ES 350 with 67,000 miles and they are talking about totaling my vehicle over $3,000 in damages.
I live in Florida, so I believe there is a 70% rule, but this would put the value of my vehicle at about $4,300 dollars. It’s Kelly blue book is approximately $8,100.
I get the final word tomorrow, but say they total the vehicle and attempt to pay me $4,300 dollars. What are my options? Should I just lawyer up immediately? Is this type of thing that I even take to court?

Allstate - Allstate reversed liab over 1 year later..
Friend was in a MVA where she was going straight, CV was coming down driveway. CV did not stop, was given citation for reckless driving. She was injured, sought normal treatment. Ambulance/ER/PT/some testing. She had wage loss. VA is the state. Allstate found their insured 100% AF. Zoom forward over a year, 7 months out from SOL in VA. Demand got sent. 1 month after demand sent, Allstate changes liab states 'obtained data' speeding at 12.8 mph over limit on our side. That REALLY is not adding up for this road. There were no skid marks and she slowed down and moved into the other lane trying to avoid but the guy never looked... The PR shows she was doing the speed limit, however, the officer did not arrive or witness any speed. The other guy admitted it was his fault on the scene, but by the time he was being given the citation his fam was there insisting she was speeding(they didn't even see the accident... would be biased anyways). I find it mighty fishy it would take this long for any process to be started on an EDR and I work in insurance, I've never even seen a claim where EDR was pulled on a personal auto. I don't know how they obtained any data bc at this late in the claim I think chain of custody would be an issue and also the extraction method. I'm not sure where that vehicle has been bc it was a TL. Since VA is pure contributory, now with the reversal it's heading to our insurance, which is fine, we had the coverages. The issue lies with the pure contributory. If our insurance also finds the same, they could deny as well is my understanding. I doubt they will, but it's still quite concerning. How is this not a bad faith claim? Doesn't the VA statute say they would have to get permission to access that type of data? Don't they have to be forthcoming on how they obtained that data? This is a very weird situation and could end up costing a lot of money if both ins companies end up denying liab. Allstate already paid for the TL a long time ago. My understanding is even if the title was signed over, the VA statute states they can't access without request since they are an insurer and not using the vehicle for daily routine use. I'm not 100% they pulled EDR, but I can't figure out anything else that makes sense with that verbiage they are delivering. Any ideas?
Allstate Insurance - Claim has taken 2 months to this point and ZERO update.
Hey everyone. Need some insight from anyone who can chime in! So I am with Allstate Insurance. I had a collision with my truck (driving slow, hit a patch of black ice and my truck goes right into a transformer box(those green boxes that you usually see somewhere in a residential area ) and my truck is totaled.
It’s been 2 months since I’ve filed the claim and I’ve basically heard nothing since. I have been calling 3-4 times a week, leaving 2-3 emails a week. Basically nothing.
Just curious what should I do since it seems like claims never should take this long?
Allstate - 6 months and no communication from my adjuster
I filed a renters theft claim through Allstate in September 2024. Our adjuster calls a couple of days later going over the process and the next steps. We’ve submitted the police report, receipts and a ton of pics. A different person who works with our adjuster calls and has us resubmit everything about 3 more times. We’re now 6 months into this claim and have heard from our adjuster other than that one time when they first called.
The other woman, we haven’t heard from her since January. We have been trying to get ahold of both for months. I finally get a call last week saying they have everything they need and that our adjuster would call that same day. I got really excited hoping this nightmare with them was going to finally come to an end. Here we are a week later and not a word from either of them and now I’m pissed. I have been cordial this whole time and now I’m at the highest level of pissivity.
At this point I’m losing my mind because why is this taking 6 months? Why is there no update? Why can’t I get and update or get ahold of my adjuster? Customer service refused to let me speak to the adjusters supervisor. What else can I do at this point?
Allstate - other driver's insurance repairing (not replacing) my car: what are your thoughts?
hello. i posted about this before, but three weeks ago, a drunk driver hit me and totaled my 2016 subaru. we just got our bill (to be paid by his insurance, all state): around $9,500, and an additional $1,000 to $2,000 with a rental. i need to go over my belongings for damage, but i had a $600 dog kennel (gunner) too: waiting on an email to see whether or not this needs to be replaced like children's car seats.
his insurance wants to fix it, not replace it, although we only bought my subaru at around $10,000 (we spent a few thousand on repairs, but not anything big: my parents wanted new brakes for peace of mind). how badly will a rebuild that large damage our ability to sell? should we fight it: and how do we? we live in colorado.
