CA legal liability - Minor MVA in California
In October 2024, I was in a very small and minor MVA. I rear ended a vehicle at a stop light when I let my foot off the gas pedal (less than 10 mph at most). I have CA legal liability.
Location: California
My problem is that the driver is claiming excessive damage to the vehicle. He's claiming bodily injury to himself and his child.. There was no child present and I know for a fact that the impact did not cause any vehicle damage.
My insurance has already paid $2000 for vehicle damage and has prepared an offer of $8000 for bodily injury (as of 4/4/25)..
What can I do?? Legally? My insurance is advising that they will represent me should the other party not accept the offer.
I'm taking this very personally, and it's hard not to feel like the other party is abusing the system (my personal opinion in respect to my recall of events).
